1. Acceptance of Terms

By downloading, installing, or using the Faxio application ("App") or visiting faxio.site ("Website"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App or Website.

2. Description of Service

Faxio provides a mobile application that enables users to send fax transmissions from their iOS device to fax numbers worldwide. Services include document import, electronic signature, fax delivery, delivery tracking, and fax history management ("Service").

3. Eligibility

You must be at least 13 years old to use Faxio. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Account Registration

Some features may require you to create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at support@faxio.site if you suspect unauthorized use of your account.

5. Subscriptions and Payments

Faxio offers subscription plans and pay-per-use credit packages processed through Apple's In-App Purchase system. By purchasing a subscription:

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.
• You can manage and cancel subscriptions in your Apple ID account settings.
• No refunds are provided for partially used subscription periods.
• Purchased credits do not expire and are non-refundable except as required by applicable law.

All prices are in USD and subject to change. We are not responsible for any additional fees charged by your carrier or financial institution.

6. Acceptable Use

You agree to use Faxio only for lawful purposes and in compliance with all applicable laws and regulations. You must not use the Service to:

• Send unsolicited faxes (spam) or fax advertising in violation of applicable laws (including the TCPA)
• Transmit illegal, harmful, threatening, abusive, defamatory, or obscene content
• Infringe on any third party's intellectual property rights
• Harass, stalk, or harm any individual or organization
• Attempt to gain unauthorized access to our systems or another user's account
• Engage in any activity that disrupts or interferes with the Service
• Misrepresent your identity or impersonate another person

We reserve the right to suspend or terminate accounts that violate these rules.

7. Intellectual Property

The Faxio App, Website, and all associated content, features, and functionality (including design, text, graphics, logos, and software) are owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of our materials without prior written permission.

You retain all rights to the documents and content you transmit through Faxio. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of delivering your fax transmissions.

8. Privacy

Your use of Faxio is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Fax delivery depends on third-party networks and we cannot guarantee delivery to all fax numbers in all circumstances.

10. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or service interruption, arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months prior to the claim.

11. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Third-Party Services

The App integrates with Apple's services for distribution and payments. Your use of such third-party services is subject to their respective terms and policies. We are not responsible for the practices of third-party services.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Continued use of the Service after changes constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in courts of competent jurisdiction, as applicable.
